Terms & Conditions of sale of the minorquines.fr website

The Terms & Conditions of Sale define the conditions which are applicable to any sale concluded between any individual or company (« the Customer ») and the company MinorquinesMinorquines ») on the website www.minorquines.fr.

These Terms & Conditions of Sale must be read carefully and be accepted before you place an order.

Minorquines reserves the right to modify its Terms & Conditions of Sale at any time and the conditions applicable are those in effect at the date the order is placed.

1 – Vendor identification

www.minorquines.fr is a website of the company Minorquines, a limited liability company with a capital of 10 000 euros.

2 – Product presentation

The products proposed for sale are described and presented with as much accuracy as possible. Minorquines cannot be held responsible for any mistake or omission.
The products are proposed for sale within the limits of available stock.
Every measure has been taken to provide accurate product images for each product for sale on the site.

3 – Product prices

Prices include VAT but exclude delivery costs.

4 – Geographical coverage

Worldwide except the United States of America and non-French West Indies, South Korea and Hong Kong.

5 - Orders

The order placement procedure is as follows :

  • selection of product(s) which are added to your basket;
  • validation of basket contents;
  • identification on the website;
  • choice of delivery option and acceptance of Terms & Conditions of Sale;
  • choice of payment method;
  • confirmation of payment.

6 - Identification

When the Customer places their first order, they have to register by providing their name, address, delivery address (if different from postal address) and email.
In order to make it easier to identify the Customer, the Customer specifically authorises Minorquines to save a « cookie » file on the customer’s hard drive.

7 – Payment

7.1 – Payment methods

The Customer has the choice of the following methods of payment :

  • Credit/debit card (Visa – Mastercard)
    The Customer supplies the number of the credit/debit card, expiry date and card verification code (CVC).
  • Paypal
    The Customer accesses the Paypal platform to carry out the transaction (by credit card or via a Paypal account) under the usual conditions and security standards provided by Paypal.
  • Cheque (France and Monaco only)
    Made out to Minorquines and sent to the following address: Minorquines – 12 rue Charles de Gaulle, 78350 Jouy-en-Josas, France
  • Bank transfer
    When this option is selected, the Customer obtains the bank account details of Minorquines in order to make the bank transfer.

If the Customer pays the order by credit/debit card or Paypal, the Customer confirms his order by clicking on the « Confirm » button.

If the Customer pays by cheque or bank transfer, the articles ordered are reserved for 5 days and the order is only definitively accepted once payment has been received.

7.2 – Payment security

Minorquines uses the secure payment service of the bank Société Générale (Sogenactif) which includes SSL security protocol. Confidential information, such as the 16-digit credit card number, expiry date and CVC are communicated in encrypted form to the bank’s secure server without ever going through the Minorquines server.

8 – Order delivery or collection from the Minorquines premises

8.1 – Delivery

Delivery is carried out to the address specified on the order form within the agreed geographical area.
The risk is the Customer’s responsibility from the moment the products leave the Minorquines premises.
If the goods are damaged during transport, a motivated claim must be made to the transport company, within 3 days of delivery.

8.2 – Collection from the Minorquines premises

By appointment (Tel. +33 (0)1 39 43 83 90), at the following address : 12 rue Charles de Gaulle, 78350 Jouy-en-Josas, France.

9 – Treatment of uncollected parcels by the transport provider

9.1 : Return to sender on account of “No such person at this address” or "Parcel not claimed" (from the post office within the holding period)
Minorquines will contact the Customer to re-dispatch or refund their order.

9.2 : Return to sender on account of "Parcel refused"

A credit note will be credited to the customer account within 3 working days following the return of the parcel to Minorquines. The Customer can request the cancellation of the credit note and apply for a refund on the "Customer Service" page of the website.

10 – Exchange (mainland France and Monaco only) or cancellation

Please notify us of any exchange or return in the «My account» section of our website.
The period during which the Customer can request an exchange or exercise his right to cancel the contract is 14 days from the date on which the parcel is received.
The Customer should keep the proof of deposit stamped by the post office until Minorquines has confirmed they have received the returned parcel.
If you ask for a refund, and subject to the observation of the above-mentioned return conditions, Minorquines will refund the returned articles within 15 days of the articles being returned to stock.

The returned articles should be new and not used.

  • For an exchange or a refund, the return postage expenses are 100%free for the countries below:
    France (without Dom-Tom) - Germany - Austria – Belgium – Spain – Ireland – Italy – Luxemburg – Holland – Portugal – United-Kingdom
    The Customer will receive by email a link allowing him to print a pre-printed return label to stick on his parcel before dropping it off at the post office of his choice.
    The cost of returning and re-dispatching your goods is free of charge for a maximum of 2 exchanges for the same order.
  • For the others countries, the return postage expenses are the responsibility of the customer.

11 - Guarantee

The products supplied by Minorquines are covered by the statutory guarantee provided for by articles 1641 and following of the French Code of Civil Law.
Any complaint, request for exchange or refund must be lodged by email at : contact@minorquines.fr.

12 – Conditions of the Refer-a-friend scheme

The Customer can refer friends who have not yet signed up on the Minorquines website and win discount vouchers.

To refer friends, the Customer has to enter the friends’ surnames, first names, and email addresses in the My Account – Refer a friend section of the website.

The friend referred by the Customer will receive an email from Minorquines inviting them to register on the website and offering them a 5 € discount voucher which will be automatically proposed when they place their first order.

When the friend makes their first purchase, the Customer will in turn receive a 5 € discount voucher visible on the My Account page and presented when they place their next order.

At all times, in the Friends Pending section, the Customer can see the names of friends who haven’t made a purchase after receiving their discount voucher and send them a reminder email by clicking on Remind my friends.

13 - Liability

In the online selling process, the vendor’s only obligation is to exercise due care; the vendor cannot be held liable for any damage resulting from the use of the Internet network.

At all the stages of access to the website, consultation, form filling, order placing, article delivery or any other service, the only obligation of the company Minorquines is to exercise due care.

Consequently, Minorquines cannot be held liable for any inconvenience or damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, interruption of service, or any other problems which are unintentional and have nothing whatsoever to do with the diligence and precautions taken by Minorquines.

14 – Intellectual property

All the components of the Minorquines website are and remain the exclusive intellectual property of Minorquines.

No one is permitted to copy, show, broadcast or use any content of the website, whether it be software, visuals or sound, for any other purpose whatsoever, even partially. Any simple or hypertext link directing to the Minorquines website and using framing, deep-linking, in-line linking techniques or any other deep-link technology is strictly prohibited without the prior written agreement of Minorquines.

15 – Personal data

In accordance with the French Act N° 78-17 on Data Processing, Data Files and Individual Liberties of 6th January 1978, the nominative information concerning the buyer can be the object of automatic data processing.

The buyer can object to the disclosure of his personal data to third parties by informing Minorquines of this objection. The users also have a right to access and rectify personal data pertaining to them, in accordance with the aforementioned Act of 6th January 1978.

The automatic data processing operations carried out by Minorquines, including the management of website users’ email addresses, are the object of notification N° 1581954, made to the CNIL on 9th April 2012.

16 - Archiving - Proof

Minorquines will archive sales orders and invoices on a reliable and durable storage medium, representing a true copy, in accordance with the provisions of article 1348 of the French Code of Civil Law.

17 – Settlement of disputes

The present Terms & Conditions of Sale shall be governed by and construed in accordance with French law. In the event of dispute, the Customer irrevocably submits to the exclusive jurisdiction of the competent court of the city where Minorquines has its head office, notwithstanding the plurality of defendants or the introduction of third parties.
